Terms of Service

These terms are an agreement between you and zekhoi, the developer of Daylime. By creating an account or using Daylime, you agree to them. If you do not agree, do not use the app.

Using Daylime

You must be at least 13 years old to use Daylime. TODO: confirm the minimum age to match the privacy policy. If you are under the age of majority where you live, you need a parent or guardian’s permission.

You are responsible for keeping your account secure. Tell us right away if you think someone else has access to it.

Your content

Your journal entries, mood logs, and other content you create belong to you. You give us permission to store, process, and show your content only as needed to run Daylime for you, including sending it to our AI provider when you use the AI companion. The privacy policy explains how we handle it.

Acceptable use

Do not use Daylime to:

• Break the law or violate anyone else’s rights.
• Try to access other people’s accounts or data.
• Interfere with, overload, or attack the service or its infrastructure.
• Use the AI companion to generate content that is illegal, harmful, or abusive.
• Resell the service or access it through automated means we have not allowed.

The AI companion is not professional advice

The AI companion is a reflection tool. Its replies are generated by an AI model, can be wrong or incomplete, and are not medical, psychological, legal, or other professional advice. It is not a therapist and cannot diagnose or treat any condition.

Do not rely on it in an emergency. If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line right away.

Open source

The Daylime source code is published on GitHub under its own license. TODO: name the license. That license covers the code. These terms cover your use of the Daylime app and the service we run.

Ending your account

You can stop using Daylime and delete your account at any time.

We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to by law. Where reasonable, we will tell you first and give you a chance to export your content.

If we ever shut down Daylime, we will give you at least 30 days’ notice so you can export your content. TODO: confirm the notice period.

Disclaimers

Daylime is provided “as is” and “as available”. We work to keep it reliable, but we do not promise that it will always be available, error free, or that your data will never be lost. Keep your own copy of anything important.

Limitation of liability

To the fullest extent the law allows, zekhoi is not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of Daylime. If we are found liable, our total liability is limited to the amount you paid for Daylime in the 12 months before the claim, or USD 50 if you paid nothing. TODO: confirm this cap.

Nothing in these terms limits liability that cannot be limited by law.

Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page, and for significant changes we will tell you in the app or by email before they take effect. If you keep using Daylime after that, you accept the new terms.

Governing law

These terms are governed by the laws of the Republic of Indonesia. Any dispute will be handled by the courts of Indonesia, unless the law where you live gives you the right to bring a claim there.
